The National Unity Reconciliation and Development Party (NURP) founding member, Moses Kibalama has appealed against a court verdict that allowed Robert Kyagulanyi to take over the leadership of the party.
Moses Nkonge Kibalama the former founding president of the National Unity, Reconciliation and Development Party (NURP) on earlier in September made a U-turn when he said he wanted to have his party back but was defeated by the current leader Robert Kyagulanyi Ssentamu.
He again on Wednesday filed a joint appeal with Paul Kagombe Ssimbwa against the decision that granted former presidential aspirant Kyagulanyi leadership of the party in the Court of Appeal in Kampala.
The two contend that Justice Musa Ssekaana injudiciously exercised his discretion and court’s inherent powers when he joined them as applicants and condemned them to costs.
“The trial judge erred in law and fact by holding that we had crossed over to being applicants and the applicant’s lawyers were ours, whereas not,” Kibalama contends.
The two are represented by Web Advocates and Solicitors, and Mugabi Shyaka and Company advocates.
Kibalama and Kagombe are therefore seeking a court order for the retrial of the matter, so that it is determined on its merits not as earlier done.
